Earp Cohn has represented clients in numerous construction and development projects. We have served institutional, industrial and other clients in major development activities, including the development of industrial projects, hospitals and other health care facilities, office buildings, shopping centers, residential and commercial condominiums, and other commercial and residential projects.
As the regulation of the use and development of real property has increased over time, Earp Cohn's attorneys have guided real estate development clients through the myriad complexities of the land use and zoning approval process. We have assisted clients in obtaining from municipal and county boards subdivision, site plan, general development plan and planned unit development plan approvals, as well as approvals of use and other zoning variances.
As developable land has become more and more scarce, municipalities and developers have sought to make better use of previously developed, but now underutilized, properties through the planning tools of condemnation and redevelopment. We have represented municipalities in creating and implementing redevelopment plans, and have also represented developers in becoming designated as redevelopers of properties located in redevelopment zones.
Earp Cohn has experience in representing lenders and borrowers in a wide array of real estate financing transactions, including acquisition and construction loans, permanent loans and refinancings, letter of credit arrangements, and other financing arrangements.
Our real estate practice also includes a variety of commercial real estate leasing transactions. We have represented institutional (including REIT) and other commercial landlords in their leasing negotiations and transactions, including the preparation of master lease forms for use at their properties. Earp Cohn attorneys have also represented tenants and subtenants in negotiating leases. We have extensive experience in drafting and negotiating office leases, industrial leases, warehouse leases, ground leases, shopping center and other commercial and retail leases.
